Last Updated: [Insert Date, e.g., February 2026]

OVERVIEW Welcome to The Tailor Fishing Rod Shop! The terms “we”, “us” and “our” refer to The Tailor Fishing Rod Shop. We operate this website and online store, including all related information, content, features, tools, products, and services (the “Services”).

These Terms of Service (“Terms”), together with any policies referenced herein (including our Return and Refund Policy and Privacy Policy), describe your rights and responsibilities when using the Services.

Please read these Terms carefully, as they include important information about your legal rights, warranty disclaimers, and limitations of liability.

By visiting, browsing, interacting with, or using our Services (including placing orders), you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, do not use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms, you represent that you are at least 18 years old (the age of majority in Australia) or have the consent of a parent/guardian if under 18.

To use certain Services (e.g., purchasing), you may need to provide accurate information such as your name, email, billing, payment, and shipping details. You warrant that all information you provide is correct, current, and complete, and you have the right to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Do not share, transfer, sell, or license your account.

SECTION 2 - OUR PRODUCTS We strive for accurate product descriptions and images. However, colours, appearance, or details may vary due to your device, screen settings, or lighting. We do not guarantee that products will match exactly what is shown.

Product descriptions, availability, and pricing may change without notice. We may limit quantities, discontinue products, or restrict sales to certain persons, regions, or jurisdictions at our discretion.

SECTION 3 - ORDERS Placing an order is an offer to purchase; we reserve the right to accept or decline it for any reason. Your order is accepted (and a contract formed) only when we confirm it (e.g., via email) and process payment. Review orders carefully before submission—we may not accommodate changes or cancellations after acceptance. If we decline, modify, or cancel an order, we will notify you using the contact details provided.

Purchases are subject to our Return and Refund Policy [LINK]. You warrant that items are for personal or household use, not for resale or commercial export without our consent.

SECTION 4 - PRICES AND BILLING Prices and promotions may change without notice. The price charged is the one displayed at checkout and confirmed in your order email (excluding taxes, shipping, handling, customs, or import duties unless stated).

You must provide current, accurate payment and account information and update it promptly. You warrant that your payment method is valid, you are authorised to use it, and charges (including taxes and shipping) will be honoured.

SECTION 5 - SHIPPING AND DELIVERY Delivery times are estimates only and not guaranteed. We are not liable for delays caused by carriers, customs, weather, or events beyond our control. Title and risk of loss pass to you upon handover to the carrier.

SECTION 6 - INTELLECTUAL PROPERTY The Services, including trademarks, logos, text, images, graphics, designs, and content, are owned by us, our affiliates, or licensors and protected by Australian and international intellectual property laws.

You may use the Services for personal, non-commercial purposes only. Without our prior written consent, you may not reproduce, modify, distribute, display, or create derivative works from any part of the Services. All rights not expressly granted are reserved.

SECTION 7 - OPTIONAL TOOLS We may provide access to third-party tools “as is” without warranties or liability. Use them at your own risk and review their terms.

SECTION 8 - THIRD-PARTY LINKS The Services may link to third-party sites or content. We are not responsible for them. Access or use is at your own risk.

SECTION 9 - RELATIONSHIP WITH SHOPIFY The Services are powered by Shopify. Purchases are directly with us, not Shopify. You release Shopify from liability related to your transactions with us.

SECTION 10 - PRIVACY POLICY Your personal information is handled per our Privacy Policy [LINK] and Shopify’s privacy practices (as applicable). By using the Services, you consent to collection, use, and disclosure as described.

SECTION 11 - FEEDBACK Any ideas, suggestions, or feedback you submit grants us a perpetual, royalty-free, worldwide licence to use it for any purpose. We have no obligation to respond or compensate you.

SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS We may correct errors in pricing, descriptions, or availability (including after order submission) without notice.

SECTION 13 - PROHIBITED USES Use the Services lawfully only. You must not: violate laws; infringe IP; harass others; transmit spam/malware; impersonate; or interfere with the Services. We may terminate access for violations.

SECTION 14 - TERMINATION We may terminate your access at any time. Surviving sections (e.g., IP, liability, governing law) continue.

SECTION 15 - CONSUMER GUARANTEES AND DISCLAIMER OF WARRANTIES Our goods come with guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded. These include guarantees that goods are of acceptable quality, fit for purpose, match descriptions, and are safe/durable as reasonably expected.

Nothing in these Terms excludes, restricts, or modifies your rights under the ACL or any other law where such exclusion is prohibited. To the extent permitted by law (and except for ACL guarantees), the Services and products are provided “as is” without warranties of any kind.

SECTION 16 - LIMITATION OF LIABILITY To the fullest extent permitted by law (including the ACL), we, our affiliates, officers, employees, and agents are not liable for indirect, consequential, special, or punitive damages arising from your use of the Services or products (even if advised of the possibility). Our total liability is limited to the amount paid by you for the relevant product/service or resupply/repair as required under ACL.

SECTION 17 - INDEMNIFICATION You indemnify us against losses, claims, or liabilities arising from your breach of these Terms, violation of law, or misuse of the Services.

SECTION 18 - SEVERABILITY If any provision is unenforceable, it is severed without affecting the rest.

SECTION 19 - WAIVER; ENTIRE AGREEMENT No waiver of any breach is a waiver of others. These Terms are the entire agreement.

SECTION 20 - ASSIGNMENT We may assign these Terms; you may not without our consent.

SECTION 21 - GOVERNING LAW These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of Queensland Courts.

SECTION 22 - CHANGES TO TERMS We may update these Terms; continued use constitutes acceptance. Check periodically.
